If your Vietnam labor permit is about to expire, you can proceed to extend it to prolong your working period in Vietnam. Information on required documents, cases that are allowed to be extended, and procedures for extending Vietnam labor permits for foreigners can be found below.
Procedures for extending labor permits for foreigners in 2024 are based on Labor Law No. 45/2019/QH14 and Decree No. 152/2020/ND-CP, effective from February 15, 2020.
Validity of the labor permit can be extended for a maximum of 2 years and can only be extended once.
When applying for labor permit extension for foreigners in Vietnam, you need to prepare the following documents:
Note: If the documents are in foreign language, they must be translated into Vietnamese and consular legalized (except exempt cases under international treaties).
At least 5 days but not more than 45 days before the expiry date of the labor permit, the employer must submit an application for extension to the competent governmental organization that issued the previous labor permit.
The labor permit is registered for a period of 5 days. In case the extension is not granted, a written response will be given, clearly stating the reason.
For foreign workers working under a labor contract, after being granted an additional time for the labor permit, the employer and the foreign worker must sign a labor contract by prescribed documents before the expected date of continuing to work for the employer.
The employer must send the signed labor contract upon request to the competent authority. The employment contract is the original or a certified copy.
