Procedures for Re-issuance Vietnamese Labor permit When It’s Lost Or Damaged

For various reasons, labor permits can be lost or damaged. Do I have to pay an administrative penalty if I lose my labor permit? and what is the procedure for re-issuance the labor permit in this case?

Like other documents, foreigners will be re-issued when they lose their labor permit. According to the provisions of Vietnamese law, administrative penalties are only applied to cases which foreign workers do not have the labor permit or have the expired labor permit.

1/ Cases of being re-granted Vietnamese labor permit

Re-issuance of Vietnamese labor permit in the following cases:

+ Having labor permit but this valid labor permit has been lost, damaged or the contents of the labor permit have been changed.

+ The labor permit is valid for at least 5 days but not more than 45 days.

2/ Documents for re-issuance of labor permit in case of loss

For re-issuance when losing labor permit, you need to prepare these below documents:

• Request form for re-issuance labor permit in accordance with the regulations of the Ministry of Labor, War Invalids and Social Affairs.
• 1 photocopy or 1 certified copy of lost labor permit
• 02 color photos 4×6cm, white background, taken within 6 months.
• Certificate of lost labor permit by the commune or ward police or a foreign competent agency in accordance with the law.

3/ Procedure for re-issuance of a lost labor permit in Vietnam

+ Within 03 days from the date the employee discovers that his/her labor permit is lost or damaged, he/she must report it to the employer/enterprise.

+ Within 05 days from the date the employer/enterprise receives the foreign worker’s notification that the labor permit is lost or damaged, the employer must submit the documents to the provincial Labor Administration where the labor permit has been issued to obtain a new labor permit.

+ Processing time for re-issuance Vietnamese labor permit is 03 days from the date receipt of complete documents. If the documents are incomplete and invalid as required, the competent authority will not re-issue the labor permit but will reply and clearly state the reason.

4/ Validity of Vietnamese labor permit reissued due to loss

In case of re-issuance the lost labor permit, the validity on the re-issued labor permit will be equal to the validity of the issued labor permit minus the time the foreign worker has worked up to the time of applying again the labor permit.

Validity of Vietnamese labor permit as prescribed is not more than 02 years.
