Procedures for Extending Vietnam Labor Permit for Foreigners in 2024

Procedures for extending labor permits for foreigners in 2024 are based on Labor Law No. 45/2019/QH14 and Decree No. 152/2020/ND-CP, effective from February 15, 2020.

1/ Cases eligible for Vietnam labor permit extension

• The labor permit is valid for at least 5 days and must not exceed 45 days.
• Demand for using foreign workers is approved by the competent authority.
• Documents proving that the foreign worker continues to work for the employer according to the contents of the issued labor permit.

Validity of the labor permit can be extended for a maximum of 2 years and can only be extended once.

2/ Documents for applying Vietnam labor permit extension for foreigners

When applying for labor permit extension for foreigners in Vietnam, you need to prepare the following documents:

• Labor permit extension form according to Form No. 11/PLI.
• 02 color photos (size 4cm x 6cm, white background, straight face, bare head, no colored glasses), photos taken not older than 6 months.
• The valid labor permit which has been issued.
• Written approval of the need to employ foreign workers.
• Copy of valid passport.
• Health certificate.
• Documents proving that the foreign worker continues to work for the employer according to the contents of the issued labor permit.

Note: If the documents are in foreign language, they must be translated into Vietnamese and consular legalized (except exempt cases under international treaties).

3/ Procedures for extending Vietnam labor permit for foreigners 2024

At least 5 days but not more than 45 days before the expiry date of the labor permit, the employer must submit an application for extension to the competent governmental organization that issued the previous labor permit.

The labor permit is registered for a period of 5 days. In case the extension is not granted, a written response will be given, clearly stating the reason.

For foreign workers working under a labor contract, after being granted an additional time for the labor permit, the employer and the foreign worker must sign a labor contract by prescribed documents before the expected date of continuing to work for the employer.

The employer must send the signed labor contract upon request to the competent authority. The employment contract is the original or a certified copy.
